January 20, 2020: David Steinberg, Esq., Of Counsel to McCabe Coleman Ventosa & Patterson, just scored his second win in recent months in the Appellate Division, Second Department.

Our client hired the firm after being found guilty at trial of multiple felonies. Although she was sentenced to 6 years in State Prison, David was able to obtain the client’s release pending appeal and a sentence reduction to time-served and felony probation.

Thanks to David’s incredible skill, advocacy and hard work, this first-time-offender avoided a lengthy prison sentence and will remain at home with her family.

February 3, 2020: Our lawyers like to GET THINGS DONE. Here's what Partner, Christopher S. Coleman, has been up to lately:

• Negotiated, advised and consummated a Commercial Lease Agreement with Option to Purchase in an amount in excess of One Million ($1,000,000.00) Dollars for a commercial building in Ulster County involving a Phase I Environmental Site Assessment (providing client with protection against potential liability related to hazardous or environmental issues) and further negotiation based upon the results obtained; negotiation and closing of commercial loan with local lending institution to occur in Spring of 2020.

• Negotiated, advised and closed on a complex Five Million ($5,000,000.00) Dollar loan refinance of a commercial building in New York City involving both residential and commercial tenants, a CEMA (allowing client to to reduce the amount of mortgage tax payable to New York State upon closing) and a SWAP (allowing client to reduce exposure against interest rate fluctuations and obtain a lower interest rate).

• Advised two different clients on two separate deals to reject proposals to purchase income generating properties in the Hudson Valley and Albany areas (one for approximately One Million ($1,000,000.00) Dollars and the other for in excess of Four Million ($4,000,000.00) Dollars) based upon proposals involving substantial and unacceptable risks to client and otherwise on highly unfavorable terms. While certainly not as common or satisfying as negotiating and closing a complex real estate/business transaction, occasionally the most cost-effective and best decision one can make is to walk away from a deal before investing unnecessary time, effort and fees (legal and otherwise) which will never be recouped – and so advising a client reflects clearly a lawyer’s obligation to his client.

February 12, 2020: Partner, Steven K. Patterson, recently achieved another phenomenal result in a criminal case by getting a B felony charge reduced to a non-criminal offense.
Our client was charged with Criminal Possession of a Controlled Substance in the Third Degree for possession of psilocybin-containing "magic" mushrooms.
Steven challenged the legality of the police conduct, arguing that the search of our client's vehicle was performed in violation of the 4th amendment to the US Constitution. As a result, he convinced the prosecutor to reduce the charge to a Disorderly Conduct. The defendant went from facing up to 9 years in prison to a $120 surcharge and a sealed record with no criminal conviction.
